Corporate, Commercial Law and Dispute Resolution · Contracts, Commercial Law and Transactions
Accounts receivable tax risk arises when outstanding customer debt is not supported by contracts, reconciliation records, collection activity or a consistent accounting policy. During a tax inspection, long-standing or doubtful receivables can attract questions about profit recognition, bad-debt provisions and the genuine nature of the underlying transactions.
Documentation of Receivables
Contracts, invoices, acceptance documents and correspondence should demonstrate how the receivable arose and why it remains outstanding. Missing or inconsistent records can make a legitimate commercial debt more difficult to explain.
Overdue and Doubtful Debt
Long-outstanding receivables should be reviewed periodically. Management needs to understand whether the debt remains recoverable, whether collection action is being taken and how the accounting treatment reflects the current position.
Bad-Debt Provisions
Provisions should be supported by the company's accounting policy and by evidence showing why the debt is considered doubtful. The calculation and accounting entries should be capable of reconciliation with the receivables ledger.
Limitation Periods
Expired limitation periods can affect whether a receivable remains enforceable and how it should be classified. Businesses should therefore monitor important debt dates instead of waiting until an inspection to reconstruct the history.
Preparing for a Tax Inspection
collect contracts, invoices, acceptance documents and correspondence;
perform an internal inventory of receivables;
reconcile balances with counterparties where possible;
document collection efforts and claims;
check provisions against the written accounting policy.
Disputed Tax Findings
If the tax authority challenges the treatment of a receivable, the defence position should connect the original commercial transaction, accounting treatment and subsequent collection history. The same evidence will be relevant if the issue proceeds to an administrative appeal or court.
Receivables control strategy should treat outstanding debt as both a financial asset and a potential tax-audit issue. Regular reconciliation, documented collection work and consistent accounting treatment make the company's position easier to defend and improve management visibility over cash recovery.
