Tax notice-decision appeal gives a taxpayer an administrative mechanism for challenging conclusions reached after a Ukrainian tax inspection before moving the dispute to court. Effective preparation depends on preserving the accounting, contractual and transaction documents that support the taxpayer's position.
Tax inspections may result in an inspection report and a tax notice-decision alleging breaches of tax legislation. Disagreement with the findings can generally be pursued through an administrative complaint or through judicial proceedings, depending on the chosen strategy and procedural stage.
Administrative Filing Period
A tax notice-decision may be challenged within 10 working days from receipt. A complaint can be submitted in writing or electronically and should be supported by properly certified copies of the documents relied on by the taxpayer.
Administrative and Judicial Routes
Administrative appeal. A complaint challenging the tax decision is submitted to the State Tax Service of Ukraine with supporting evidence showing why the assessment or conclusions are unfounded.
Judicial appeal. Court proceedings may follow the administrative stage or, depending on the procedural choice, be initiated directly. The source material describes a one-month period after completion of the administrative procedure for the subsequent court claim.
Choice of procedure matters because moving directly to court may affect the ability to use the administrative appeal route afterwards. Procedural sequencing should therefore be considered before the first complaint or claim is filed.
Information to Include in the Complaint
company name;
Unified State Register of Enterprises and Organisations of Ukraine (EDRPOU) code and tax address;
name of the State Tax Service body that issued the tax notice-decision;
details of the disputed notice-decision;
grounds for the appeal;
references to the applicable legal provisions;
list of attached supporting documents.
Evidence should be assembled around the actual disputed transactions and the findings recorded in the inspection documents. A general disagreement with the tax authority is usually less useful than a structured response supported by contracts, primary accounting records, payment evidence and other relevant documents.
Administrative tax appeal preparation should combine the deadline, factual evidence and legal grounds in one coherent complaint. Proper sequencing preserves the taxpayer's options and creates a stronger position if judicial review becomes necessary.
