Commercial cassation appeal in Ukraine is used to challenge an appellate commercial court decision on the grounds available at cassation level. Unlike a new trial, cassation focuses on legal and procedural issues that may justify review of the decisions already made by lower courts.
A cassation appeal against a decision of an appellate commercial court is filed within twenty days. Because the cassation stage follows both first-instance and appellate review, the grounds should be identified precisely before the filing period expires.
Role of Cassation Review
Cassation is not simply a third opportunity to repeat the same factual arguments. Preparation requires analysis of the lower-court judgments, procedural record and the legal rules that were allegedly applied incorrectly.
