Court Order Proceedings for Commercial Debt

Commercial court order proceedings provide a simplified mechanism for certain monetary claims arising directly from a written contract. The procedure is designed for claims where the creditor's right to payment can be established from documents without the full structure of ordinary claim proceedings.

Who Can Use the Procedure

Legal entities and individual entrepreneurs may participate as applicant or debtor where the statutory requirements for order proceedings are met. The applicant must be the person who owns the relevant right of claim.

Order proceedings are not designed for every type of dispute. Where recovery is sought jointly from several debtors, including joint and several liability, ordinary claim proceedings may be required because the simplified procedure does not provide for multiple applicants or multiple debtors in the same way.

Monetary Obligations

The central requirement is normally a monetary obligation arising directly from a contract. This includes situations where one party supplied goods, performed work or provided services and the other party became obliged to pay the agreed price.

The evidence should show the contract, performance and the amount due. Where the claim involves contested facts, non-monetary remedies or a more complex set of parties, ordinary litigation may provide the more appropriate procedural framework.

Choosing the Correct Procedure

Using the wrong procedural form can create delay. Before applying for a court order, the creditor should verify the nature of the obligation, the parties involved and whether the documentary record is sufficient for the simplified process.

The source material also distinguishes order proceedings from ordinary claim proceedings where several claimants or several debtors are involved. Joint or several liability, multiple legal grounds or a dispute requiring examination of contested facts can make ordinary litigation more suitable even when the underlying obligation is monetary.

Form and content requirements are central to this procedure. The source material refers to Article 150 of the Commercial Procedural Code of Ukraine for application requirements and Article 152 for additional grounds on which issuance may be refused. Filing an application therefore does not guarantee that a court order will be issued.

Court order recovery for commercial debt can reduce procedural complexity when the claim is a documented contractual payment obligation and the case fits the statutory limits of order proceedings.
