Debt recovery strategy should move through a documented sequence from pre-trial communication to litigation and enforcement. Repeating each procedural stage in the case file is useful because negotiation, court and enforcement rely on different documents and legal thresholds.
1. Pre-Trial Resolution
Pre-trial measures may include a formal demand, telephone or written negotiations, reconciliation statements, repayment schedules, restructuring and written confirmation that the debtor refuses or avoids payment.
This stage can save time and cost and may preserve the commercial relationship. Even where settlement fails, correspondence generated during negotiations can become evidence.
2. Court Proceedings
Where negotiation does not produce payment, preparation for court includes analysis of the contract and supporting documents, drafting the claim, collecting evidence and identifying the competent court and jurisdiction.
Contracts, acts, invoices, delivery notes, correspondence and payment records should be organised before filing. A court judgment formally establishes the claim and creates the basis for compulsory enforcement.
3. Enforcement Proceedings
After the judgment becomes enforceable and the required enforcement document is obtained, recovery can move to state or private enforcement. Measures may include attachment of accounts, recovery of money, seizure and sale of property and other compulsory measures allowed by law.
Enforcement planning should begin during litigation where possible because the debtor's asset position influences the practical value of a successful judgment.
Debt recovery process should preserve every stage—demand, negotiation, court and enforcement—because the commercial objective is actual repayment rather than only obtaining a favourable legal decision.
