Unlawful tax authority demands should be separated from legitimate taxpayer obligations before documents are supplied or payments are made. A business can protect its position by recording the demand, checking its legal basis and challenging requirements that exceed the authority's powers while continuing to comply with lawful requests.
Signs That a Demand May Be Unlawful
a request for documents not required by law or unrelated to the specific inspection;
a demand for tax, penalties or interest without an appropriately issued decision or supporting act;
use of an inspection procedure that does not comply with the prescribed timing or sequence;
absence of required inspection notice or other material procedural documents.
Step 1: Record the Demand
Requests should be retained in written or electronic form together with copies of letters, inspection records, emails and proof of receipt. Oral instructions that may affect the taxpayer's position should be documented internally and, where appropriate, confirmed in writing.
Step 2: Analyse the Legal Basis
The taxpayer should identify what provision or procedural power the authority relies on, whether the request falls within the scope of the inspection and whether the requested information is relevant to the matter under review.
Step 3: Submit a Formal Objection
Where a demand is unsupported, a written objection can set out the factual circumstances, explain why the requirement is unlawful and refer to the legal provisions or procedural rules relied on by the taxpayer.
Step 4: Escalate the Dispute
Continued unlawful conduct may be challenged before a higher tax authority or through court proceedings. The complaint should identify the disputed demand, the taxpayer's response and the specific right or procedure that has been breached.
Continue to Meet Lawful Obligations
Challenging one unlawful requirement does not remove other valid tax duties. Filing deadlines, legitimate information requests and undisputed tax obligations should continue to be managed so that the dispute does not create additional penalties.
Taxpayer response strategy should distinguish clearly between what must be provided, what can be challenged and what evidence needs to be preserved. Written records and timely objections reduce the risk that an unsupported demand becomes accepted by default.
