International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (ICAC at UCCI) provides a forum for international commercial disputes where the parties have a valid arbitration agreement. Effective arbitration requires a properly drafted claim, a workable arbitration clause, organised evidence and a clear plan for recognition and enforcement of the award.

Preparing a Claim before ICAC

Preparation may include analysis of the international contract, review of the arbitration clause, drafting the statement of claim, organising the evidence, calculating the amount claimed, preparing procedural documents and assessing the international-law issues relevant to the dispute.

Claim preparation requires precise formulation of the relief sought and compliance with the procedural rules governing the arbitration. Contract documents, delivery records, invoices, correspondence, payment evidence and expert materials may form part of the evidential record.

Representation in International Commercial Arbitration

Representation may include participation in hearings, preparation of the legal position, analysis of arbitration practice, negotiations with the counterparty and protection of the client's interests throughout the proceedings.

The process normally follows a repeated sequence: preliminary dispute analysis, formulation of claims and defences, preparation of evidence, participation in hearings, consideration of settlement opportunities, review of the award and preparation for enforcement.

Arbitration Clauses

An arbitration clause is a central provision of an international commercial contract. Defective wording may create jurisdiction disputes, delay proceedings or complicate recognition and enforcement of the award.

Clause work can include drafting and reviewing arbitration clauses, checking the scope of disputes referred to arbitration, adapting contracts, reviewing international commercial risks and aligning dispute-resolution provisions with the chosen arbitral institution.

Recognition and Enforcement of Awards

Obtaining an award is not the final stage. Enforcement work may include legal analysis of the award, preparation of recognition and enforcement documents, representation before courts or enforcement authorities and coordination of enforcement in Ukraine or abroad.

International awards may require recognition and enforcement under applicable international conventions and national procedural rules. The enforcement plan should therefore be considered from the beginning of the dispute, particularly where debtor assets are located outside Ukraine.

ICAC arbitration strategy should connect the contract, arbitration clause, evidence, hearing process and future enforcement so that the award can produce a practical commercial result rather than remain only a successful decision on paper.
