Pre-trial recovery of personal debt is useful where one individual owes money to another and the documentary record is incomplete, informal or disputed. The objective is to reconstruct the obligation, create evidence of the creditor's demand and test whether repayment can be achieved before a civil court claim becomes necessary.
Civil debt cases can be more difficult where the parties did not sign a detailed loan agreement or other formal document when the money was provided. Evidence may therefore need to be assembled from receipts, transfers, correspondence, acknowledgements and the parties' later conduct.
What Pre-Trial Work Includes
The process normally begins with analysis of the creditor's situation and all available materials. The amount, date of the obligation, agreed repayment terms and any missed deadlines should be reconstructed as accurately as possible.
A formal demand can then set out the obligation and request repayment within a defined period. Depending on the circumstances, settlement proposals may address instalments, a revised schedule or another arrangement that provides a documented route to payment.
Preparing for Possible Court Proceedings
Where voluntary settlement fails, the same pre-trial work should prepare the evidential basis for litigation. This may include calculation of the principal debt, relevant delay periods, contractual or statutory penalties and interest for use of another person's funds where the source material and legal basis support such claims.
Legal work can also include preparation of procedural documents, representation before public authorities or courts, analysis of the judgment and, where required, an appeal.
Where no formal loan agreement exists, the evidential review becomes especially important. Bank transfers, messages confirming receipt of money, requests for additional time and partial repayments may help establish the relationship and the debtor's acknowledgement. The pre-trial stage can therefore strengthen a case that initially appears to lack conventional documentation.
Personal debt recovery strategy should use the pre-trial stage to document the obligation, establish a realistic payment deadline and prepare the case for court without wasting time on indefinite informal negotiations.
