Tax litigation in Ukraine requires a case strategy that combines tax law, administrative procedure, financial evidence and the factual history of the audit or disputed transaction. Court work may require statements of claim, objections, written explanations, motions and appellate or cassation submissions. Each filing should connect the requested remedy with the evidence and the relevant legal argument.
Court representation
Representation includes participation in hearings, presentation of the taxpayer's legal position and responses to arguments advanced by the tax authority. Complex financial matters may require the evidence to be explained in a form that is clear outside the accounting context.
Enforcement of the judgment
A favourable judgment may still require follow-up with the tax authority to remove unlawful assessments, implement the court's directions or process a return of funds where applicable.
Tax court strategy should be prepared from the evidence backwards: first establish what the records prove, then determine the procedural and legal arguments that support the requested court remedy. This produces a more defensible position than relying on general objections to the tax authority's conduct.
