State or Private Enforcement Officer: Choosing for Debt Recovery

Choice of enforcement officer in Ukraine can materially affect how quickly a court judgment turns into actual recovery. State and private enforcement officers have broadly comparable enforcement powers, but workload, communication, case selection and operational approach may differ.

State Enforcement Officer

A state enforcement officer works within the State Enforcement Service under the Ministry of Justice. State officers may handle categories of decisions that private enforcement officers are not permitted to execute, including certain matters involving state bodies or state property.

Private Enforcement Officer

A private enforcement officer is an independent professional authorised to conduct enforcement activity. Private officers often handle fewer proceedings at the same time and may provide more direct communication with the creditor.

Both types of officer may use enforcement measures such as attachment of accounts and property, recovery of funds, search for assets and other compulsory actions available under enforcement legislation.

When a Private Officer May Be Preferable

Private enforcement can be attractive where speed is important, the debt is significant, identifiable assets exist and the creditor wants active monitoring of the proceeding. The officer's remuneration structure can also create a stronger operational focus on recovery.

When State Enforcement Is Required or More Suitable

State enforcement may be necessary for categories excluded from private enforcement. It may also be considered where the debt is relatively small or the creditor does not want the additional cost structure associated with private enforcement.

Checks Before Filing

Asset information can influence the decision. Useful checks may include real estate, vehicles, bank accounts, corporate rights and other existing enforcement proceedings. Experience, responsiveness and the officer's track record in comparable cases are also relevant practical criteria.

Communication and workload are practical differences. State enforcement often proceeds through formal correspondence, while a private officer may provide more immediate contact by telephone or electronic channels. Regardless of the officer selected, the creditor should retain copies of requests, decisions and asset-search results and react quickly to inactivity.

Both state and private officers can attach property and bank accounts, recover money, search for assets and take other compulsory measures within their authority. The practical difference is therefore not simply the list of powers; it is whether the case category is legally available to the selected officer and how actively the proceeding is managed.

Enforcement officer selection should be based on the category of decision, value of the debt, available debtor assets and the level of active case management required to achieve real recovery.
