Customs Law and Foreign Economic Activity · Customs Law and Foreign Economic Operations
Customs fine response for volunteers and charities should begin immediately after the organisation receives the customs decision. The first objective is to identify the alleged breach, obtain the formal decision and choose between payment, administrative appeal and court protection without missing the stated procedural deadlines.
Step 1. Identify the Reason for the Fine
Common reasons include:
errors in the customs declaration or missing documents;
expiry of a temporary-import period;
breach of conditions for preferential import;
incorrect classification of the goods.
Step 2. Obtain a Copy of the Customs Decision
The decision should identify the legal provision allegedly breached, the amount of the fine and the procedure for challenging the decision.
Step 3. Analyse the Case
review the customs documents and the factual circumstances;
prepare the legal position and supporting evidence;
select the appropriate defence or appeal procedure.
Step 4. Decide Whether to Pay or Appeal
The organisation can assess whether the fine should be paid or challenged through the available administrative or judicial procedure.
Step 5. Prepare the Complaint
The complaint should be supported by:
a copy of the customs decision;
documents confirming the organisation’s position;
a legal explanation of why the fine should be cancelled or changed.
Step 6. Reduce Future Customs Risk
check customs requirements before importing humanitarian assistance;
prepare declarations and supporting documents carefully;
respond promptly to customs requests for information or clarification.
Customs fine defence strategy depends on rapid document collection, a clear explanation of the import and compliance with the appeal procedure. Volunteers and charities can reduce financial loss and cargo delays by treating the customs decision as a formal legal process from the day it is received.
