Employment of Foreign Nationals in Ukraine
Employment of foreign nationals in Ukraine requires the employer to check whether a work permit is needed, obtain the permit where required, formalise the employment relationship and complete the related migration steps. Work authorisation is tied to the employer, position and permitted period stated in the relevant documents.
Work Permit Requirement
Where Ukrainian law requires a permit, the employer applies for authorisation to employ the foreign national for the relevant period. The permit confirms the right of the person to work in a specified position for the employer named in the filing.
Where a foreign national works in several positions or for several companies, separate authorisation may be required for each employment relationship. Highly qualified specialists may combine positions where the additional work remains within the period covered by the main permit.
Categories Described as Not Requiring a Standard Work Permit
employees of emergency and rescue services;
foreign nationals holding permanent residence in Ukraine;
employees of representative offices of foreign companies working under the relevant service card;
other categories exempted by Ukrainian law or international agreements;
professional athletes, artists and performers;
persons holding recognised refugee status;
persons under temporary protection or asylum arrangements;
media, maritime and aviation personnel in the stated categories;
university lecturers and research staff;
persons engaged in international technical-assistance projects;
clergy working for religious organisations.
Employment of a person holding permanent residence proceeds in a manner comparable to employment of a Ukrainian citizen. It also describes temporary substitution work for an absent employee for up to 60 calendar days during a year in the stated circumstances.
Documents for a Work Permit
application in the prescribed form identifying the position, foreign national, employer and requested permit period;
copy of the foreign national's passport with notarised Ukrainian translation;
one photograph measuring 35 × 45 mm;
employer-certified draft employment contract or agreement specifying the position, rights and duties, salary, working conditions and schedule in compliance with Ukrainian labour law.
Documents are filed with the competent employment authority or an authorised administrative-service centre. Consideration takes at least one week, after which the employer receives notice and pays the permit fee within ten business days before the work-permit form is issued.
Work authorisation may also provide the basis for applying for a Temporary Residence Permit (TRP), allowing the employment and migration formalities to be planned together.
Permit Period and Fees
Source material links the permit period to the category of foreign worker. It describes up to three years for certain special categories and seconded foreign employees, and one year for other categories, subject to renewal.
Permits for refugees and persons requiring additional protection are issued without the standard fee. For other foreign nationals it gives a fee linked to the requested employment period:
two subsistence minimum amounts for employment up to six months;
four subsistence minimum amounts for employment from six to twelve months;
six subsistence minimum amounts for employment from one to three years.
