Entry in the Register of Non-Profit Organisations in Ukraine
Non-Profit Registration
Non-profit status in Ukraine requires an eligible enterprise, institution or organisation to satisfy the statutory and charter requirements and to be entered in the relevant register of non-profit organisations.
The entity must be established and registered under the law applicable to its non-profit form. Its constitutive documents must prohibit distribution of income or profit, or any part of it, among founders, members, employees other than salary and related USC accruals, and other related persons. The documents must also provide for transfer of assets on termination to one or more non-profit organisations of the relevant type, other qualifying legal entities providing non-state pension support, or the budget, subject to the exceptions for certain condominium-owner associations and housing-construction cooperatives.
The source lists budget institutions; public associations; political parties; creative unions; religious and charitable organisations; pension funds; unions, associations and other combinations of legal entities; housing-construction, dacha, gardening and garage cooperatives; associations of co-owners of apartment buildings and associations of residential-property owners; trade unions and their organisations; employers' organisations and their associations; agricultural service cooperatives; and cooperative associations of agricultural service cooperatives.
After entry in the register, the non-profit organisation may request an extract confirming its registered status.
Procedure for Obtaining Non-Profit Status
Prepare the application and supporting documents for entry in the register of non-profit organisations.
Submit the documents and complete entry in the non-profit register.
Non-profit registration may also be available to a cooperative established to provide services directly to its members; qualifying non-profit status are exempting funds received into the cooperative's account from taxation under that model.
